§2 General 

All services provided by the online shop (Velken-Folientechnik GmbH) are provided to the customer exclusively on the basis of the following General Terms and Conditions. Deviating regulations shall only be valid if they have been agreed between the online shop (Velken-Folientechnik GmbH) and the customer.

§3 Conclusion of contract 

3.1 The offers of the online shop (Velken-Folientechnik GmbH) on the Internet represent a non-binding invitation to the customer to order goods in the online shop.

3.2 By ordering the desired goods on the Internet, the customer submits a binding offer to conclude a purchase contract if you have gone through the online ordering process by entering the information requested there and click on the "Order subject to payment" button in the last ordering step.

After you have sent your order, we will send you an e-mail confirming receipt of your order by us and listing its details (confirmation of receipt).

3.3 The online shop (Velken-Folientechnik GmbH) is entitled to accept this offer within 2 business days by sending an order confirmation. The confirmation shall be sent by e-mail. After fruitless expiry of the 2-day period, the offer shall be deemed to have been rejected.

3.4 The contract is concluded exclusively in German.

3.5 Your orders will be stored by us after the conclusion of the contract. Should you lose your documents relating to your orders, please contact us by email/fax/telephone. We will gladly send you a copy of your order data.

§4 Order process in the online shop 

You order in our shop by going through the following steps:

1) You place items in your shopping cart without obligation by clicking on "add to cart".

2) You can view all the items you have placed in the shopping basket by clicking on the shopping basket in the top right-hand corner. Here you can also delete items or change the quantity.

3) If you would like to buy the items in your shopping cart, click on "Checkout". This will take you to the method you would like to use to place your order: With an existing "customer account" or as a "new customer". Clicking on "Login" will take you to the ordering process. If you are already logged in to your customer account, this step is not necessary.

4) As a new customer, first enter your billing and delivery details. Please make sure that you spell your address correctly. Clicking on "Select payment & shipping" will take you to the ordering process. Here you can choose the payment & shipping method.

5) Before you send your order, you will receive an overview of the data of your planned orders (value of goods, shipping costs, total amount).

6) By clicking on the button "Order with obligation to pay" you send your order to us. By doing so, you are offering us the conclusion of a purchase contract.
You will find the information about the time of the conclusion of the contract in the corresponding section in the GTC. In the case of the payment methods Paypal, credit cards, Sofortüberweisung and paydirekt, the order will only be sent to us after the payment process has been successfully completed.

§5 Shipping costs 

5.1 All items will be delivered within three working days, if available from stock and not otherwise stated on the item page.
Delivery is made both within Germany and to non-European and EU countries according to the following lists:

  Allowance for bulky goods

Parcels longer than 120 cm are considered bulky goods because they can no longer pass through the normal belt conveyor systems of the parcel centres. Instead, the parcels are sorted by hand. The shipping service providers charge an additional service fee for this.

The ordered goods (film) may therefore only have a maximum widthor height of 115 cm in order not to be declared as bulky goods. The online shop automatically recognises whether the film dimensions exceed 115 x 115 cm. In this case, a bulky goods surcharge will be levied depending on the desired shipping service:

  DHL Packstation
For delivery to a DHL Packstation, the parcel must not be longer than 60 cm. The ordered goods (film) may therefore only have a maximum widthor height of 57 cm. The Online Shop automatically recognises whether delivery to a DHL Packstation is possible.
  Express delivery
In case of delivery by UPS Express, your order will go through our production preferentially. Your order will be processed as quickly as possible and prioritised, but we cannot guarantee that the goods will be dispatched on the same day. UPS delivery is guaranteed at the next day.
  Letter delivery for small quantities
If you have small quantities of accessories in your shopping basket, you have the option of having them sent to you by post (cost: 2.70 EUR).
  Delivery conditions
  • All articles will be delivered within three working days, if available from stock and not otherwise stated on the article page.
  • If an item is not available at short notice, we will inform you by e-mail about the expected delivery time. Your legal claims remain unaffected.
  • In the event of non-availability of the ordered goods, we reserve the right not to deliver. In this case, we will inform you immediately and refund any consideration already received without delay.
  • Shipment to a post office box (with the exception of Packstation) is not possible. In the case of deliveries to countries outside the EU, e.g. Switzerland, any taxes, such as customs duties or fees, are not included.
  • If delivered items show obvious material or manufacturing defects or transport damage, please report such defects immediately to us or to the carrier who delivers the items. The customer is not obliged to do so and this is not a prerequisite for asserting your claims. However, we cannot otherwise assert any claims against the carrier. Compliance with the above provision shall not affect your statutory claims insofar as you have ordered for private purposes as a consumer.
  • You agree that the e-mail address you provide will be transmitted by us to the parcel service provider and may be used by them in the context of parcel delivery. You may revoke this consent at any time. Please note that in the event of revocation, you will no longer be able to directly influence the delivery of the parcels being dispatched. Please send any revocation to the following address: info@velken.de.
  Returns
  • The customer shall pay a return fee of EUR 5.00 per shipment within Germany for undeliverable packages, provided that the shipping service provider is not responsible for the undeliverability. The return fee may be higher abroad.
  • Shipments are undeliverable if no person authorised to receive the shipment within the meaning of section 4 paragraphs 2 and 3 of the DHL Parcel/Express National GT&C can be found and the collection period has expired fruitlessly, acceptance by the recipient or authorised recipient is refused for reasons that cannot be substantiated, or the recipient cannot be identified. Refusal to accept also includes the prevention of delivery via an existing receiving facility (e.g. gluing/no posting at the letterbox or parcel box), refusal to pay the additional charge, COD amount or refusal to hand over the confirmation of receipt.
  Resending parcels
In Germany, resending parcels costs EUR 5.90 per item and EUR 9.90 per bulky item. Abroad, the shipping costs may be higher.

¹ When importing the goods by UPS into Switzerland, UPS will pay the respective amount of Swiss VAT for you at the border. This sum will be invoiced to you later in a separate invoice from UPS. In addition to this, UPS charges a flat fee of CHF 20 for the credit provided.

In this case, an additional bulky goods surcharge of 20.00 EUR will be levied if the shipping service provider DHL is selected, 9.90 EUR for UPS and 6.99 EUR for GLS.

Fees / customs duties / value added tax

For deliveries to non-EU countries, additional country-specific customs duties, taxes and fees may apply. The amount of the fees depends on the respective country of delivery. Please enquire about these fees at your local customs office. These fees are to be paid by you. Furthermore, depending on the transport company commissioned, additional service and processing fees may be incurred over which we have no control and which are also to be borne by you. For each delivery that we arrange for you to non-EU countries, we will issue the invoice net, i.e. without German VAT. The prices are duty unpaid and untaxed.
Swiss customers pay Swiss VAT and import duty to the delivery company upon receipt of the goods. Further information specifically for Switzerland can be found at http://xtares.admin.ch/tares/login/loginFormFiller.do.

5.2 We do not participate in a VAT refund for goods exported abroad.

5.3 If an item is not available at short notice, we will inform you by e-mail of the expected delivery time. Your statutory claims remain unaffected.

5.4 In case of unavailability of the ordered goods, we reserve the right not to deliver. In this case, we will inform you immediately and refund any consideration already received without delay.

5.5 Shipment to a post office box (with the exception of Packstation) is not possible. In the case of deliveries to countries outside the EU, e.g. Switzerland, any taxes, such as customs duties or fees, are not included.

5.6 If delivered items have obvious material or manufacturing defects or transport damage, please report such defects immediately to us or to the carrier delivering the items. 5.7 You agree that the e-mail address you provide will be transmitted by us to the parcel service provider and may be used by them in the context of parcel delivery.
You may revoke this consent at any time. Please note that in the event of revocation, you will no longer be able to directly influence the delivery of the parcels being dispatched. Please send any revocation to the following address: info@velken.de.

§6 Shipping terms 

6.1 For the delivery we charge shipping and packaging costs according to the table under paragraph 5.1.

6.2 For orders with a value of more than 29.00 Euro we deliver free of charge within Germany.

6.3 If desired, the customer can choose between different courier services for shipping within Germany. There are no additional costs.

6.4 Shipments to other European countries with film dimensions exceeding 115 x 115 cm are subject to an additional bulky goods surcharge of 20.00 euros.

6.5 The customer shall pay a return fee of 5.00 euros per shipment within Germany for undeliverable packages, provided the undeliverability is not the fault of the shipping service provider. In other European countries, the return fee may be higher.
Shipments are undeliverable if no person authorised to receive the shipment within the meaning of section 4 paragraphs 2 and 3 of the DHL Parcel/Express National GT&C can be found and the collection period has expired fruitlessly, acceptance by the recipient or authorised recipient is refused for reasons that are not comprehensible, or the recipient cannot be identified. Refusal to accept shall also be deemed to be the prevention of delivery via an existing receiving facility (e.g. taping/prohibition of posting at the letter box or parcel box), the refusal to pay the surcharge, COD amount or the refusal to hand over the acknowledgement of receipt.

§7 Payment 

7.1 All prices stated are final prices which include the statutory value added tax of currently 19% without costs of packaging and shipping at the time of the order.

Promotional offers in our shop may be limited in time or quantity. Details can be found in the product description.

7.2 The following methods of payment are possible for deliveries within Germany:

7.2.1 Prepayment

  • The customer is obliged to pay the purchase price immediately after conclusion of the contract by bank transfer to our account. The payment term is:

    If you pay in advance, you will receive an e-mail from us with the exact invoice details. Therefore, please be sure to enter your e-mail address and/or your telephone number in the order form so that we can contact you. Please state the order number and the name of the person placing the order as the purpose of payment when making your transfer so that we can allocate your payment to the order.

    The ordered items will be reserved for you for 14 days until receipt of payment.

7.2.2 paydirekt

  • When paying via paydirekt, the customer is guided directly to the payment. Please state the order number and the name of the customer as the reason for payment when making your transfer so that we can allocate your payment to the order.
    The earliest time of the account debit is immediately after the transaction has been transmitted.

7.2.3 Credit card

  • When paying by credit card, the customer is taken directly to the payment. Please state the order number and the name of the customer as the purpose of payment so that we can allocate your payment to the order.
    The following credit cards are accepted: VISA, MasterCard, American Express.
    The earliest time the account can be debited is immediately after the transaction has been transmitted.

7.2.4 PayPal

  • When paying via PayPal, the customer is taken directly to the payment.
    Please state the order number and the name of the customer as the purpose of payment so that we can allocate your payment to the order.
    The earliest time the account will be debited is immediately after the transaction has been transmitted.

7.2.5 Purchase on account (for companies and public authorities from Germany)

  • This only applies to authorities, public institutions and selected companies. The customer is obliged to pay the invoice amount within the period stated on the invoice after receipt of the goods. A cash discount deduction is expressly not permitted! The term of payment is:

7.2.6 Klarna

  • In cooperation withKlarna Bank AB (publ), Sveavägen 46, 111 34 Stockholm, Sweden, we offer the following payment options. Payment is made to Klarna in each case:

    • Invoice: the payment period is 14 days from the date of dispatch of the goods/ticket/ or, in the case of other services, the provision of the service.     • Payment by instalments: With Klarna's financing service you can pay for your purchase in fixed or flexible monthly instalments according to the conditions stated in the checkout.     The use of the payment methods invoice, hire purchase and direct debit requires a positive credit assessment. In this respect, we forward your data to Klarna for the purpose of address and creditworthiness checks as part of the purchase initiation and processing of the purchase contract. 7.3 For deliveries abroad, the payment methods prepayment, credit card, PayPal, instant transfer, purchase on account or direct debit are available depending on the selected billing country.
If the payment method prepayment is selected, all bank charges incurred shall be borne by the payment sender. Sharing of charges (i.e. foreign bank charges shall be borne by the payment sender, domestic bank charges by the payment recipient) is not permitted.

7.4 The delivered goods shall remain our property until payment has been made in full (retention of title according to §§158, 449 BGB). If the agreed payment deadlines are exceeded, we must charge reminder and processing fees.

§8 Right of withdrawal 

Right of withdrawal for consumers
Consumers are entitled to a statutory right of withdrawal. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed.

You have the right to cancel this contract within fourteen days without giving any reason. The revocation period is fourteen days from the day on which you or a third party named by you, who is not the carrier, has or has taken possession of the goods.

by means of a clear declaration (e.g. a letter sent by post, fax or e-mail) of your decision to revoke this contract. You may use the enclosed model withdrawal form for this purpose, which is, however, not mandatory.

In order to comply with the withdrawal period, it is sufficient for you to send the notification of the exercise of the right of withdrawal before the expiry of the withdrawal period.

Consequences of cancellation

If you withdraw from this contract, we must refund all payments we have received from you, including delivery costs (with the exception of additional costs resulting from the fact that you have chosen a type of delivery other than the cheapest standard delivery offered by us), without delay and at the latest within fourteen days of the day on which we received notification of your withdrawal from this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged for this repayment.

We may refuse repayment until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier.

You must return or hand over the goods to us without delay and in any case no later than fourteen days from the day on which you notify us of the cancellation of this contract. The deadline is met if you send the goods before the expiry of the period of fourteen days.

You shall bear the direct costs of returning the goods.
You only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary for checking the condition, properties and functioning of the goods.


8.1 The right of withdrawal does not apply to distance contracts for the delivery of goods that are not prefabricated and for the manufacture of which an individual selection or determination by the consumer is decisive or which are not suitable for return due to their utilisation (e.g. used foils). To enable you to check the goods before purchase, we will send appropriate samples on request.

§9 Warranty 

9.1 Complaints are only justified if the defect in the goods has been reported to our customer service before processing. After the goods have been used, it can no longer be clearly determined what caused the defect.
Justified complaints will only be considered if they are submitted in writing within 14 days of receipt of the goods, together with the evidence. Defects in a part of the delivery cannot lead to a complaint about the entire goods. When processing our goods, existing instructions for use must be observed or prior samples must be taken. Deviations in quality, dimensions and quantities customary in the industry, even in the case of custom-made products with excess or short deliveries of up to 10%, shall not constitute grounds for complaint.
We accept no liability for defects caused by non-observance of our processing instructions or by frost, chemical, electrochemical, weather or other unforeseeable influences. Special orders and custom-made products are excluded from return.

9.2 The statutory provisions shall apply. The limitation period for statutory claims for defects is 2 years.

9.3 Should delivered items show obvious material or manufacturing defects or transport damage, please report such defects immediately to us or to the carrier delivering the items. The customer is not obliged to do so and this is not a prerequisite for asserting your claims. However, we cannot otherwise assert any claims against the carrier. Compliance with the above provision shall not affect your statutory claims insofar as you have ordered for private purposes as a consumer.

9.4 We shall not be liable for defects which have arisen as a result of incorrect handling, normal wear and tear or through external influence. In the event of repairs to the goods carried out by the customer or by third parties without our written consent, the warranty claim against us shall expire.

9.5 The manufacturing tolerance for foil cuts is plus/minus one millimetre.

§10 Liability 

10.1 The online shop (Velken-Folientechnik GmbH) shall be liable in cases of intent or gross negligence in accordance with the statutory provisions. Liability for guarantees shall be independent of fault. For slight negligence the online shop (Velken-Folientechnik GmbH) shall be liable exclusively in accordance with the provisions of the Product Liability Act, for injury to life, limb or health. However, the claim for damages for the slightly negligent breach of essential contractual obligations shall be limited to the foreseeable damage typical for the contract, unless liability exists due to injury to life, limb or health. The online shop shall be liable for the fault of vicarious agents and representatives (Velken-Folientechnik GmbH) shall be liable to the same extent.

10.2 The provisions of the preceding paragraph (10.1) shall apply to damages in addition to performance, damages in lieu of performance and claims for reimbursement of expenses incurred in vain, irrespective of the legal grounds, including liability for defects, delay or impossibility.

10.3 The online shop (Velken-Folientechnik GmbH) shall not be liable for glass breakage or other damage occurring after film coating or painting. The assumption of costs of any kind whatsoever is expressly excluded. Our technical specifications refer to non-binding manufacturer specifications.

 §11 Note on the duty to inform about the possibility of recognising and correcting input errors, Article 246 § 3 No. 3 EGBGB (Introductory Act to the German Civil Code)

We expressly point out that the entries can in principle be checked again at any time, in particular also after clicking the order button. You can correct your input in particular by deleting the item in the shopping basket or by closing the last window opened (by pressing the "X" symbol).

§12 Data protection 

Data is processed in accordance with the applicable Federal Data Protection Act (BDSG) and the Telemedia Act (TMG). For the rest, reference is made to the notes on data protection.

§13 Copyright 

All third-party logos, images and graphics displayed are the property of the respective companies and are subject to the copyright of the respective licensors. All photos, logos, texts, reports, scripts and programming routines shown on these pages, which are our own developments or have been prepared by us, may not be copied or used in any other way without our consent. All rights reserved.

§14 Miscellaneous 

14.1 We have no influence if articles are taken out of the programme by our suppliers and are therefore no longer available or have been changed in type and design. Should a replacement article be offered to us by the supplier, we will inform you of this. Your legal claims remain unaffected.

14.2 Our shop www.velken.de bears the quality seal EHI Geprüfter Online-Shop. In order to obtain this seal, we are regularly checked by the EHI Retail Institute GmbH for compliance with the criteria of the EHI Code of Conduct. 14.3 We are neither obliged nor willing to participate in a dispute resolution procedure before a consumer arbitration board.

§15 Foil installation 
  1. Scaffolding, electricity and water connections and other private or public requirements necessary for the installation shall be provided by the customer - unless otherwise agreed in writing - in any case free of charge for us.
  2. If the customer/client has caused the delay of the installation - at least negligently - the Velken-Folientechnik GmbH withdraw from the contract in whole or in part without notice and charge the customer/client for the costs incurred by us up to that point.
  3. Should it come about that the installation, for which only one journey is required, cannot be completed for reasons caused by the customer/client, such as e.g. incorrect information on sizes or number of glass surfaces, the glass surfaces are not accessible or similar, additional costs will be charged: a. Travel costs for each additional journey in the amount of 1.19 Euro incl. VAT per distance kilometre. b. Additional installation work will be charged at an hourly rate. Additional assembly work will be charged at an hourly rate of 49.98 euros incl. VAT (unless otherwise agreed).
  4. Additional work such as clearing access to glass surfaces, disassembly and assembly of door and window fittings or glazing beads will be charged at an hourly rate of 49.98 euros incl. VAT (unless otherwise agreed).
  5. The standard widths of our films are between 900 mm and 1524 mm, depending on the product. If the width and/or height of glass surfaces exceeds these dimensions, a visible film joint is required.
  6. Any deviations in thickness, dimensions, weight, colour, content, etc. due to manufacturing are permissible within the tolerances customary in the industry; this also applies to cutting and processing.
  7. The inclusion of small dust particles cannot be ruled out during film assembly. This is known to the customer/client and is deemed to be an agreed quality, so that no warranty claims can be derived from this.
§16 Acceptance of the film installation 
  1. Acceptance of our deliveries and/or services must be carried out immediately after notified completion by the customer/client or his representative. This also applies to self-contained partial deliveries and/or partial services. Waiting times shall be charged at an hourly rate of 49.98 euros incl. VAT.
  2. Acceptance may only be refused due to significant defects until they have been remedied.
  3. Upon written notification of completion by Velken-Folientechnik GmbH the customer/client is obliged to immediately accept the deliveries and/or services in writing.
  4. If the customer/client is a merchant and no acceptance is requested, the service shall be deemed to have been accepted by the customer/client upon expiry of 14 calendar days after notification of completion by the customer/client. Velken-Folientechnik GmbH as accepted by the customer/client.
  5. If the customer/client has used the deliveries and/or services of the Velken-Folientechnik GmbH in whole or in part, the entire acceptance shall be deemed to have taken place with the expiry of 7 calendar days after the start of use.
§17 Validity of the General Terms and Conditions 

With an order, the general terms and conditions of the online shop (Velken-Folientechnik GmbH) are accepted.

§18 Place of jurisdiction 

Place of performance and place of jurisdiction is Bocholt for anyone who runs a commercial business or who is classified as a merchant in the HGB for other legal reasons, legal entities under public law and legal persons. The law of the Federal Republic of Germany shall apply exclusively.
